Terms & Conditions
These terms govern the use of this website and the web design and development services provided by Tayal Web Design, #682, Sector-20B, Old Faridabad, Faridabad, Haryana 121002, India. By engaging us or using this site, you accept them. Where a signed proposal or work order says something different, that document takes precedence.
1. Quotes and scope
Prices shown on this website are starting prices for typical projects and are not a binding offer. A binding quote is issued in writing after a discovery call and lists the agreed pages, features and timeline. Work outside that written scope is treated as a change request and quoted separately before it is carried out.
2. Payment
- A 50% advance confirms the project slot; the balance is due before the site is made live or files are handed over.
- Larger projects may be split into agreed milestones.
- All prices exclude GST unless stated otherwise. GST is charged at the applicable rate.
- Domain, hosting, premium plugins, stock images and third-party subscriptions are billed at actual cost and are not included in the design fee unless listed in the quote.
- Invoices are payable within 7 days. We may pause work on overdue accounts.
3. Your responsibilities
Projects run to schedule only when content arrives on time. You agree to supply text, images, logos and approvals promptly, and to confirm that you hold the necessary rights to all material you give us. Feedback consolidated into a single list per round keeps the project moving; scattered, contradictory feedback extends the timeline.
4. Timelines
Timelines quoted are working-day estimates that begin once the advance is received and the initial content is supplied. Delays caused by late content, slow approvals or third-party providers extend the delivery date accordingly. If a project is inactive on your side for more than 60 days, we may close it and invoice for work completed.
5. Revisions
Each package includes a defined number of revision rounds on the design concept, stated in your quote. A revision means refinement within the approved direction. A change of direction after approval, or a change to the agreed scope, is chargeable at our standard hourly rate.
6. Intellectual property and ownership
- On receipt of full payment, ownership of the final design and custom code we produce for your project transfers to you.
- You retain ownership of all content, logos and trademarks you provide.
- Third-party components (open-source libraries, themes, plugins, fonts, stock images) remain under their own licences, which pass to you as licensee.
- We retain the right to reuse generic techniques, code patterns and internal tools developed in the course of our work.
- Unless you ask us not to, we may display the completed project in our portfolio and case studies.
7. Search rankings
We build to current search engine best practice and optimise the technical and on-page factors within our control. Search engines are independent third parties and their algorithms change. We therefore do not and cannot guarantee any particular ranking position, traffic volume or revenue outcome. Any claim to guarantee a Google position should be treated with suspicion, from us or anyone else.
8. Support and warranty
We fix bugs in our own code free of charge for the support period stated in your package, counted from the launch date. The warranty does not cover changes you or a third party make after handover, failures of third-party hosting, plugins or services, content updates, new features, or damage from malware introduced through weak credentials on your side.
9. Hosting, backups and third-party services
Unless you have an active maintenance plan with us, backups, security updates, renewals and uptime of your hosting and domain are your responsibility. We are not liable for loss arising from expired domains, lapsed hosting, or outages at third-party providers.
10. Cancellation and refunds
You may cancel a project at any time in writing. Amounts already paid cover work completed up to the cancellation date and are non-refundable; if payments received exceed the work done, we refund the difference within 15 working days. Work delivered up to that point is released only once the account is settled.
11. Confidentiality
Each party agrees to keep the other’s non-public business information confidential and to use it only for the purposes of the project. This obligation survives the end of the engagement.
12. Limitation of liability
To the extent permitted by law, our total liability arising out of or in connection with a project is limited to the fees you have paid us for that project. We are not liable for indirect or consequential loss, including loss of profit, revenue, data or goodwill. Nothing in these terms limits liability that cannot be limited by law.
13. Acceptable use of this website
You agree not to attempt to gain unauthorised access to this site, submit false or automated enquiries, send spam through our forms, or copy substantial parts of the site for commercial reuse. Content on this website is provided for general information and does not constitute professional advice.
14. Governing law and jurisdiction
These terms are governed by the laws of India. The courts at Faridabad, Haryana have exclusive jurisdiction over any dispute, subject to any agreement to attempt good-faith resolution or mediation first.
15. Changes to these terms
We may revise these terms from time to time. The version in force for your project is the one published on the date your quote was accepted.
